It would be interesting to know whether a Creative Commons license has ever been enforced in court. There are lots of questions which it would probably need a professor of law to make sense of, e.g. what legal status does a Creative Commons agreements have? It's run by charitable organisation, not an international convention. Is compliance completely reliant on goodwill?
The FAQs at Creative Commons touch on some of these questions - I'm sure much more has been written elsewhere.

At Queensland University of Technology they're going to be running a Creative Commons clinic this year - perhaps we should investigate something like that for our organisation?
The Australian Copyright Council dumps a huge bucket of very cold water on Creative Commons licences in information sheet G 094 on their website http://www.copyright.org.au/publications/infosheets.htm
It does mention that "Versions of the licences, described as having been revised for Australian onditions, have been issued by an ustralian derivative project hosted at the Queensland University of Technology."
